Conditions for applying for a license to discharge wastewater into water sources: Current status of wastewater treatment system (technology process, capacity, number of systems, location, machinery and equipment, tank size) must be built in accordance with the approved EIA Report/ Decision on adjustment of the EIA Report and the Project must have a Certificate of Completion of environmental protection works during the operation phase issued by the Department of Natural Resources and Environment HCMC level.

STEP 1/ Prepare application for Certificate of completion of environmental protection works during the operation phase:

According to Decree 40/2019/ND-CP, the application for the Certificate of completion of environmental protection works in the operation phase issued by the Department of Natural Resources and Environment of Ho Chi Minh City needs to follow the following steps:

Make a plan to apply for trial operation of waste treatment works.
Take samples, analyze samples during trial operation and make reports on test operation results of waste treatment works.
Prepare reports on the results of environmental protection works.
Process and time for implementation of the plan to apply for trial operation of waste treatment works:
Implementation process:

After the Investor builds the Project's waste treatment facilities in accordance with the approved EIA (or the Decision on EIA adjustment), the Investor proceeds to make a plan to apply for trial operation of the treatment works. Waste management of the project/works according to the following steps:

Step 1: The implementing/consultant synthesizes documents and information to make a plan to apply for trial operation of waste treatment works for the Project on the legal basis provided by the Investor.
Step 2: The implementing/consultant submits documents to the Investor.
Step 3: The implementing/consultant submits the application for the trial operation plan for the Project to the Department of Natural Resources and Environment of Ho Chi Minh City.
Step 4: Ho Chi Minh City Department of Natural Resources and Environment will set up a Delegation to assess the actual status of environmental protection works according to the approved EIA of the Project (The investor must prepare the current status at the project site). Project and together with the consulting/implementing unit receive the appraisal team)
Step 5: If the actual appraisal process is approved, the Department of Natural Resources and Environment of Ho Chi Minh City will issue a written permission for the Project to pilot operation of environmental protection works under the approved EIA.

Lead time: 37 working days.

Procedure and time for taking samples, analyzing samples during trial operation and reporting results of trial operation of waste treatment works:
Implementation process:

Step 1: The investor begins trial operation of environmental protection works according to the approved EIA.
Step 2:  During trial operation (minimum 75 days, maximum 6 months), the consulting unit takes input and output samples, each stage of sample processing and analysis (15 days/1 time) ) since the beginning of trial operation of environmental protection works according to the approved EIA.
Step 3: After finishing the trial operation, the consulting unit takes and analyzes samples (1 time/day, minimum 7 days) to check the stability of environmental protection works. field to make the report on test operation results.
Step 4: The consulting unit synthesizes documents and information to prepare a report on test operation results for the Project on the basis of information provided by the Investor.
Step 5: The consultant submits documents to the Investor.
Step 6: The consultant submits the report on the test operation results for the project to the Department of Natural Resources and Environment of Ho Chi Minh City.
Step 7: Ho Chi Minh City Department of Natural Resources and Environment will set up a Delegation to assess the actual operation status of environmental protection works according to the approved EIA of the Project and take control samples for analysis ( The investor must take steps to prepare the current status of the project and together with the consulting unit receive the appraisal team)
Step 8: If the actual appraisal process is approved and the control sample meets the standards, the Department of Natural Resources and Environment of Ho Chi Minh City will issue a written notice of the results of trial operation of environmental protection works according to the EIA. has been approved.

Process and implementation time Report on the results of environmental protection works:
Implementation process:

Step 1: The consulting unit synthesizes documents and information to prepare a report on the results of environmental protection works for the Project on the legal basis provided by the Investor.
Step 2: The consultant takes samples of the current status of the project in 3 different phases (Decree 40/2019/ND-CP).
Step 3: The consultant submits documents to the Investor.
Step 4: The consultant submits the report on the results of the implementation of environmental protection works for the Project to the Department of Natural Resources and Environment of Ho Chi Minh City.
Step 5: The Department of Natural Resources and Environment of Ho Chi Minh City establishes an appraisal team and conducts actual appraisal and sampling of the Project (The investor must prepare the status quo at the Project and together with the consulting unit) receiving the appraisal team).
Step 6: If the actual appraisal is approved, the Department of Natural Resources and Environment of Ho Chi Minh City will issue a document to amend the Report on the implementation of environmental protection works for the Project.
Step 7: The consulting unit edits the report on the implementation of environmental protection works for the Project according to the document and edits it with the experts of the Department of Natural Resources and Environment of Ho Chi Minh City on the basis of information provided by the Department of Natural Resources and Environment of Ho Chi Minh City. provided by the investor.

STEP 2/ Make an application for a Permit to discharge wastewater into water sources

Implementation process:

Step 1: The consulting unit synthesizes documents and information to prepare a report on discharge of wastewater into water sources for the Project on the legal basis provided by the Investor.
Step 2: Apply for the Official Letter to connect the discharge of the Project's wastewater to the city's sewers issued by the Technical Infrastructure Management Center of Ho Chi Minh City.
Step 3: The consulting unit takes samples of the input and output wastewater after treatment of the wastewater treatment system.
Step 4: The consulting unit writes a report and submits the documents to the Investor.
Step 5: The consultant submits the Report on discharge of wastewater into water sources for the Project to the Department of Natural Resources and Environment of Ho Chi Minh City.
Step 6: Ho Chi Minh City Department of Natural Resources and Environment establishes an appraisal team and conducts actual appraisal, takes samples of wastewater at the Project's wastewater treatment system (the investor must take steps to prepare the current state of the project). at the project and together with the consulting unit to receive the appraisal team).
Step 7: If the actual appraisal is approved, the Department of Natural Resources and Environment of Ho Chi Minh City will issue a document to amend the Report on discharge of wastewater into water sources for the Project.

Step 9: Submit the Report of discharge of wastewater into the water source for the Project to issue a Permit to the Department of Natural Resources and Environment of Ho Chi Minh City.
Step 10: Ho Chi Minh City Department of Natural Resources and Environment issues a License to discharge wastewater into water sources for the project.
Implementation time: 60 working days (including the time to apply for the connection letter).

Note:

The implementation time does not include the time to provide documents and sign the report.
The implementation time depends on the legal documents of the Investor and in accordance with the initial EIA approved.
The duration of trial operation of waste treatment works is long or short depending on the trial operation progress and treatment efficiency of the Investor's environmental protection works.
Environmental records are legal documents binding the responsibility between establishments, enterprises and management agencies.

 


 

NECESSARY ENVIRONMENTAL DOCUMENTS
Companies, hospitals, hotels, industrial parks, residential areas, urban areas, etc. have production and business activities that emit emissions, solid waste, wastewater, and noise that affect the environment. All environmental documents are required.

Enterprises need to have 1 or more of the following environmental documents:

Permit to discharge wastewater into water sources.
Environmental Impact Assessment (EIA); SEA – Applies to projects specified in Appendix II of Decree No. 18/2015/ND-CP;
Environmental protection planning (replacement of commitment to environmental protection) – Apply to new investment projects, investment to expand scale, increase capacity of production, business and service establishments are not subject to the provisions of Appendix II and Appendix IV of Decree 18/2015/ND-CP.
Registering hazardous waste source owners – Pursuant to Decree 38/2015/ND-CP effective June 15, 2015 and guided by Circular 36/2015/TT-BTNMT effective 1/ September 2015.
